Pursuant to an Order of the Chatham County Clerk of Superior Court and under and by virtue of the power and authority contained in that Deed of Trust, Security Agreement and Financing Statement dated as of January 31, 2007, executed by Majaja Siler City, LLC, a North Carolina limited liability company (hereinafter “Borrower”), to Adkleco, LLC (“Original Trustee”), recorded in Book 1313 at Page 860, Chatham County Register of Deeds (“Deed of Trust”), for the benefit of Column Financial, Inc., a Delaware corporation (“Original Lender”).
Original Lender assigned all of its rights, title and interest in the Deed of Trust to Wells Fargo Bank, as Trustee, for the Registered Holders of Credit Suisse First Boston Mortgage Securities Corp., Commercial Mortgage Pass-Through Certificates, Series 2007-C2 (“First Interim Holder”), as evidenced by that certain Assignment of Deed of Trust, Security Agreement and Financing Statement, dated effective as of January 20, 2008 and recorded in Book 1392, Page 872, with the Chatham County Register of Deeds.
First Interim Holder assigned all of its rights, title and interest in the Deed of Trust to Bank of America, N.A., as Trustee for the Registered Holders of Credit Suisse First Boston Mortgage Securities Corp., Commercial Mortgage Pass-Through Certificates, Series 2007-C2 (“Second Interim Holder”), as evidenced by that certain Assignment of Deed of Trust, Security Agreement and Financing Statement and Assignment of Assignment of Leases and Rents, dated effective as of June 30, 2009 and recorded in Book 1482, Page 1079, Chatham County Register of Deeds.
Second Interim Holder assigned all of its rights, title and interest in the Deed of Trust to U.S. Bank National Association, as Trustee, successor-in-interest to Bank of America, N.A., as Trustee, successor-in-interest to Wells Fargo Bank, as Trustee, for the Registered Holders of Credit Suisse First Boston Mortgage Securities Corp., Commercial Mortgage Pass-Through Certificates, Series 2007-C2 (“Noteholder”), as evidenced by that certain Assignment of Deed of Trust, Security Agreement and Financing Statement and Assignment of Assignment of Leases and Rents dated effective as of January 1, 2011 and recorded in Book 1907, Page 191, Chatham County Register of Deeds.
Because of default in the payment of the indebtedness thereby secured and failure to carry out and perform the stipulations and agreements therein contained and, pursuant to demand of Noteholder, the undersigned Substitute Trustee will expose for sale at public auction to the highest bidder for cash at the Chatham County Courthouse, Pittsboro, North Carolina on May 26, 2017 at 11:00 A.M. all the following described real and personal property (including any improvements thereon) particularly described in the Deed of Trust, which property is being more particularly described on Exhibit A attached hereto (the “Property and/or Premises”).
The Property shall be sold “AS IS, WHERE IS”. Neither the Substitute Trustee nor the holder of the Note secured by the Deed of Trust make any representations or warranties relating to the title or any physical, environmental, health or safety condition existing in, on, at or relating to the Property, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition are disclaimed.  The sale will be made subject to all deeds of trust, liens and encumbrances, unpaid taxes, restrictions, easements, assessments, leases and other matters, if any, which, as a matter of law, survive the foreclosure of the Deed of Trust. The record owner of the Property not more than ten days prior to the date hereof is the Borrower.
Pursuant to N.C. Gen. Stat. §§ 45-21.10 (b) and 25-9-604, any successful bidder may be required to deposit immediately upon the conclusion of the sale a cash deposit not to exceed the greater of five percent (5%) of the amount bid or Seven Hundred Fifty Dollars ($750.00). Any successful bidder shall be required to tender the full balance of the purchase price so bid in cash or certified check at the time the Substitute Trustee tenders to him a deed for the interest to the Property or attempts to tender such deed and said bidder shall remain liable on the bid as provided for in N.C. Gen. Stat. § 45-21.30(d) and (e).  The purchaser of the Property shall pay for the revenue stamps on the Substitute Trustee’s Deed and the Clerk’s Commissions in the amount of $.45 per $100.00 of the purchase price (up to the maximum amount of $500.00) required by N.C.
