Pursuant to NCGS § 46.3, Mildred C. Council, having received an ownership interest in certain lands by intestate succession and desiring to make use of such ownership interest separate and apart from all others, has initiated a partition proceeding in Chatham County, North Carolina by filing of a Petition by Co-Tenant for Partition by Sale, said proceeding having the file number 14-SP-110 and the title Mildred C. Council, petitioner, v. Earl Alston, et al., respondents. The subject property to be sold has the following legal description: BEING all of that property shown on plat and survey thereof by John M. Tisdell, entitled Property of Charlie Cotton Heirs, dated February 20, 1984 and recorded in Plat Book A, page 198, Chatham County Registry, to which survey reference is hereby made for a more particular description of same. The subject property is 21.913 acres and is accessible by A Mountain View, a road accessible from Hamlets Chapel Road. Said petition alleges that an actual partition would result in substantial injury to most parties thereto.
